Yazid & Co has been appointed by Messrs Najmuddin & Partners to defend Originating Summon filed by their former clients before the Kuala Lumpur High Court seeking leave to have the solicitor final invoice be taxed before the Court Registrar.

Numerous preliminary objection raised on both technical and merit ground among other the non-compliance of mandatory time limit provided under Section 121 (1)(a) dan 126 of the Legal Profession Act 1976, no cogent reason provided for the delay, filing done as on collateral purpose and conduct of parties in negotiating progress payment also leads to an afterthought argument.

Accordingly, Notice of Application under order 18 Rule 19 Rules of Court 2012 was also filed to struck out the Originating Summon.

The Hearing date for both the Originating Summon and Striking Out application is expected to be fixed during the next Case Management scheduled on 19.3.2024.
